These Terms of Use are governed by New Zealand law and comply with the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Agreement to Terms

By accessing and using this website and our photography services, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use our services. These terms apply to all users of our services in New Zealand.

About Our Services

qorlyraxvel provides professional photography services including event coverage, portrait sessions, and lifestyle photography throughout New Zealand. All services are subject to availability and booking confirmation. We operate in accordance with New Zealand business standards and consumer protection laws.

Consumer Guarantees Act 1993

Our services are provided with the guarantees set out in the Consumer Guarantees Act 1993. This means:

  • Services will be of acceptable quality and fit for their intended purpose
  • Services will match their description
  • Services will be provided with reasonable care and skill
  • Services will be completed within a reasonable time

If our services do not meet these guarantees, you have rights under the Consumer Guarantees Act, including the right to have the service remedied or receive a refund.

Booking and Payment

Bookings are confirmed upon receipt of payment or deposit as agreed. All prices are in New Zealand Dollars (NZD) and include GST where applicable. Payment terms and cancellation policies will be clearly communicated at the time of booking. We accept bank transfers, credit cards, and EFTPOS.

A 50% deposit is typically required to secure your booking, with the balance due on the day of the session or upon delivery of images, as specified in your booking agreement.

Image Rights and Copyright

All photographs taken by qorlyraxvel remain the copyright of qorlyraxvel. However, clients receive usage rights as specified in their service package, which typically include:

  • Print rights for personal use
  • Digital sharing rights for social media and personal websites
  • Restrictions on commercial use without written permission

Unauthorised reproduction, distribution, or commercial use of images without permission is prohibited and may result in legal action. Clients may not edit or alter images in ways that misrepresent the photographer's work without permission.

Cancellation and Refund Policy

Cancellations made more than 14 days before your scheduled session will receive a full refund of any deposit paid. Cancellations within 14 days may incur a cancellation fee of up to 50% of the total booking value, unless the cancellation is due to circumstances beyond your control (e.g., illness, extreme weather).

In the event we need to cancel a session due to circumstances beyond our control, you will receive a full refund or the option to reschedule at no additional cost.

Limitation of Liability

While we strive to provide excellent service, qorlyraxvel is not liable for circumstances beyond our reasonable control, including:

  • Adverse weather conditions that prevent outdoor photography
  • Equipment failure despite reasonable maintenance
  • Client-related issues such as lateness, non-cooperation, or changes to event plans
  • Actions of third parties that affect the session

Our liability is limited to the value of the service provided. This limitation does not affect your rights under the Consumer Guarantees Act 1993.

Fair Trading Act 1986

We comply with the Fair Trading Act 1986, which means:

  • All information provided about our services is accurate and not misleading
  • We do not make false or unsubstantiated claims
  • Pricing is transparent and clearly displayed
  • We do not engage in unfair trading practices

Website Use

You agree to use our website lawfully and not to:

  • Attempt to gain unauthorised access to our systems
  • Introduce malicious software or viruses
  • Copy, reproduce, or misuse website content without permission
  • Interfere with website functionality

Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be notified on our website. Continued use of our services after changes constitutes acceptance of the modified terms. Your rights under the Consumer Guarantees Act 1993 are not affected by these terms.

Dispute Resolution

If you have a complaint or dispute, please contact us first. We are committed to resolving issues fairly and promptly. If we cannot resolve a dispute, you may:

  • Contact Consumer Protection New Zealand
  • Apply to the Disputes Tribunal for claims up to $30,000
  • Take legal action through the New Zealand courts

Governing Law

These Terms of Use are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
